1. What NightClimb is
NightClimb is a game about sleeping habits. You set a bedtime, the app scores your nights and ranks you against other players.
It is not a medical device and not medical advice. It does not diagnose, treat or monitor any condition. Sleep problems can be serious; if yours are, talk to a doctor rather than an app with an owl in it.
2. Your account
- You must be 13 or older to use NightClimb. Some countries set a higher age for agreeing to this sort of thing on your own; if you are under that age where you live, ask a parent or guardian first.
- One person per account. Keep your password to yourself.
- You are responsible for what happens on your account.
2a. What you write
Your display name and bio are public. Anyone signed in can read them.
Do not use them to impersonate somebody, to harass, to advertise, to post sexual content, or to publish anyone's private information. Anything of that sort can be reset or removed, and the account with it.
You keep ownership of what you write. You give us permission to store and show it inside the app, which is the only thing we do with it, and that permission ends when you delete it or your account.
Reporting and blocking. Open any player's profile and use the menu in the top corner. Report sends it to us to look at. Block removes them from your app immediately, both ways, without waiting for us.
3. Fair play
NightClimb is a competition, so cheating spoils it for other people.
Do not fake sleep sessions, tamper with the app or its network traffic, run it on emulators or automation to farm rank, or use multiple accounts to inflate your position. Accounts found doing this can have their rank reset or be suspended.
4. Your data and your content
Your sleep data is yours. What is collected and who can see it is set out in the Privacy Policy, which forms part of these terms.
You can delete your account at any time from Profile → Delete account. That permanently removes your profile, sleep history, rank, streaks and friendships. Feedback you sent and any moderation record are kept; the Privacy Policy explains exactly what that means and how to have feedback removed too.
If you send feedback through the app, we may use it to improve NightClimb.
5. Subscriptions
If NightClimb offers paid subscriptions:
- Payment is taken by Apple through your App Store account.
- Subscriptions renew automatically unless cancelled at least 24 hours before the period ends.
- Manage or cancel in your App Store settings. We cannot cancel it for you.
- Free trials convert to a paid subscription unless cancelled before they end.
- Refunds are handled by Apple under their policy, not by us.
- Prices shown come from the App Store in your own currency.
If you are in the EU or EEA you normally have 14 days to withdraw from a purchase. By starting a subscription you are asking for it to begin immediately, which means that right ends once it has. Apple's own refund process applies either way and is usually the faster route.
6. Availability
NightClimb is provided as it is. We try to keep it running and accurate, but we do not promise it will always be available, that scores will be perfect, or that the alarm will always ring. Do not rely on it as your only alarm for anything that matters. Phones die, updates break things, and permissions get revoked.
7. Ending things
You can stop using NightClimb and delete your account whenever you like.
We can suspend or close an account that breaks these terms, particularly the fair-play rules. If we do, we will tell you why where we can.
8. Liability
To the extent the law allows, NightClimb is not liable for indirect or consequential loss arising from using it, including missed alarms, lost sleep, or a lost streak.
Nothing here removes rights you have under the consumer law of your own country.
9. Changes
These terms may change. If a change is material you will be told in the app before it takes effect, and continuing to use NightClimb means accepting it.
10. Which law applies
These terms are governed by Norwegian law, and the Norwegian courts have jurisdiction.
If you are a consumer, that does not take away the protection of the mandatory consumer law of the country you live in, and you can always bring a claim there. EU and EEA consumers can also use the European Commission's online dispute resolution platform.
